Two subpoenas from the U.S. District Court land in Dare County

Subpoenas dated Oct. 2, 2024 addressed to Dare County Board of Commissioners and Oregon Inlet Task Force were received late this past week.

The subpoenas request documents, which Dare County will provide, for a Grand Jury for the United States District County for the Eastern District of North Carolina. The deadline to provide the documents is Oct. 16 through 18, 2024, in the Terry Sanford Federal Building in Raleigh.

County manager and attorney Robert L. Outten said, “it’s not about Dare County. They are not investigating Dare County.”

Assistant United States Attorney Dennis Duffy requested the subpoenas. He has offices in Raleigh.

Outten said when he documents are ready he will call the United States Department of Justice and ask “tell us what the next steps are?”

Relevant parties include the following persons and entities and any person or nominee representing them. The Board of Commissioners lists 16 people and entities. The Oregon Inlet subpoena lists nine.

In the subpoena to the Board of Commissioners, eight entities are listed, as follows: Banbridge, LLC; Coastal Affordable Housing, LLC; DWFHP, LLC; EJE Dredging Service, LLC; Juristrat, LLC; Metcon Construction, Pamlico Management Group, LLC; and SOAR Capital, LLC.

In the subpoena to the Board of Commissioners, the following individuals are listed as relevant parties: Bill Cook, Robert W. Ferris, James Jordan Hennessy, Donnie Potter, Aaron K. Thomas, Marion R. Warren and Judson Whitehurst.

The United States Army Corps of Engineers is also listed.

The subpoena for the Oregon Inlet Task Force lists three entities and six individuals, all of which are in the Board of Commissioners subpoena. People listed in the task force subpoena are Cook, Hennessy, Potter, Warren and Whitehurst. Entities listed are EJE Dredging, Juristrat, Pamlico Management.

The subpoena for the Board of Commissioners asks for documents related to payments to a relevant party; documents and records relating to contract bids, financial statements, budgets and other records pertaining to contract awards and work performed by EJE Dredging; the contract entered into with EJE Dredging; and much more; and pre-development contract for Coastal Affordable Housing and invoices from and payments received from Coastal Affordable Housing, LLC.

The subpoena for the Oregon Inlet Task Force wants documents and records relating to EJE dredging and the contract for implementing the dredging program along with other topics.
