The Kill Devil Hills planning board met December 17 for the first time since August 20. All members of the board were present.

The board discussed a proposed zoning amendment, Soil Erosion and Sedimentation Control, up for modification. Cameron Ray, assistant planning director, said the purpose of this amendment is “to provide rules and regulations that allow development within the town while prohibiting pollution by sedimentation.”

The amendment was adjusted to meet state requirements. Additions and corrections under the “Purpose,” “Erosion and sedimentation control plans,” “Permits,” “Inspections and investigations” and “Injunctive relief” sections were made. Section “H” was renamed “Storm Water Outlet Protection.”

Board member Mary Simpson commented that “lots of changes were made to statements that now have ‘shall’ or ‘will’ added to them.” Ray explained that “shall” will stand up in court, whereas “may” will not. “We don’t want any gray area,” Ray said.

After no further comments from the board, board member James Almoney made the motion to adopt the proposed zoning amendment. All were in favor.

The only other agenda item was to review the proposed meeting schedule for 2020. The schedule that was adopted is as follows for the KDH Planning Board:
